ORDINANCE NO. 2005-04
REVISING ORDINANCE OF THE BOROUGH ENTITLED “ AN ORDINANCE REGULATING CANVASSING, SOLICITING OR DISTRIBUTING CIRCULARS OR OTHER MATTER, OR CALLING FROM HOUSE TO HOUSE, IN THE BOROUGH OF ALLENHURST”
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE BOROUGH OF ALLENHURST IN THE COUNTY OF MONMOUTH, NEW JERSEY (not less than two-thirds of all the members thereof affirmatively concurring) as follows:
Section I. Section 5 (b) is hereby revised as follows. “No person subject to the provisions of this ordinance shall canvass, solicit or distribute circulars or other matter, or call from house to house, except between the hours of 9:00 AM and 9:00 PM, Monday through Friday.”
Section II. Section 5 (c) is hereby revised as follows. “No person subject to the terms of this ordinance shall attempt, by means of door-to-door canvassing, to solicit or otherwise contact any resident whose name(s) appear on the list of residents maintained by the Borough Administrator who do not wish to be solicited or contacted in person at their residence.”
Section III. Section (7) is hereby revised to provide as follows. “Any person violating the terms of this ordinance shall be subject to a minimum fine of two hundred dollars $200.00 and a maximum fine of one thousand dollars ($1,000.00) as deemed appropriate by the Municipal Court Judge.” Each resident contacted in violation of Section 5(c) is deemed to be a separate offense.
Section IV. This Ordinance shall take effect twenty (20) days after the first publication thereof after final passage as provided by law.
