ORDINANCE NO. 2007-10

“AN ORDINANCE AMENDING AN ORDINANCE ENTITLED, “AN ORDINANCE ESTABLISHING THE MINIMUM REGULATIONS GOVERNING THE CONDITIONS AND MAINTENANCE OF ALL PROPERTY, BUILDINGS AND STRUCTURES; BY PROVIDING THE STANDARDS FOR SUPPLIED UTILITIES AND FACILITIES AND OTHER PHYSICAL THINGS AND CONDITIONS ESSENTIAL TO ENSURE THAT STRUCTURES ARE SAFE, SANITARY AND FIT FOR OCCUPATION AND USE; AND THE CONDEMNATION OF BUILDINGS AND STRUCTURES UNFIT FOR HUMAN OCCUPANCY AND USE AND THE DEMOLITION OF SUCH STRUCTURES; KNOWN AS THE PROPERTY MAINTENANCE CODE OF THE BOROUGH OF ALLENHURST”, ADOPTED FEBRUARY 27, 2001.”

BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE BOROUGH OF ALLENHURST, AS FOLLOWS:

SECTION I ADDITIONS, INSERTIONS AND CHANGES

That the INTERNATIONAL Property Maintenance Code, 2000 is amended and revised in the following respects:

Section 302.10.0 (Page 9)

“Tents or other temporary structures” shall be amended and shall read as follows:

302.10.1 SCOPE:

“Tents or other temporary structures shall include but not be limited to tents, canopies, platforms, bandstands, reviewing stands and other similar structures. This section shall apply to both the commercial and residential districts within the Borough of Allenhurst.”

302.10.1.1

“A tent or other temporary structure may be erected on residential or commercial property, for a period not to exceed 72 hours, by obtaining a permit from the Code Official for a fee of $10.00. There shall be a limit of two permits per site per year for residential properties and twelve (12) permits per site per year for commercial properties. Persons erecting tents encompassing an area of 900 square feet or more must also obtain a permit from the Fire Official.”

302.10.1.2

“The Borough of Allenhurst shall be entitled, in all districts, to operate and conduct governmental functions and to erect and utilize such tents or temporary structures necessary for its operation as determined by the Board of Commissioners.”

SECTION II - GENERAL PROVISIONS

If any section or provision hereof shall be adjudged invalid, such determination shall not affect the other provisions hereof which shall remain in full force and effect to the extent of such conflict or inconsistency provided not otherwise required by law.

SECTION III - DATE OF EFFECT

This Ordinance shall take effect twenty days after its final passage and publication in accordance with the law.
